Fucking hell. To convict someone, you need to convict them beyond reasonable doubt. Everything we've seen up until this point counts as "reasonable doubt". It's bullshit that it's even taking this long.
Yesterday I talked about the Rittenhouse case with a liberal democrat prosecutor whom I often work with as opposing counsel. I told him that I think the jury is going to hang, because there is at least one person on each side who won't give up their position. He more or less agreed with this; he thinks the jury will hang. I told him I think it's something like 2 for guilty, and 10 for acquit. He was surprised, and told me he thinks it's the other way around - 10 for guilty and 2 for acquit.
Self-Defense is a legal defense. It's something the defendant has to prove. The prosecution does not have to prove beyond a reasonable doubt that there was no self defense. All they have to prove is that there were two homicides and an attempted homicide. Absolutely no one doubts that Rittenhouse killed two people and wounded a third; the only question is whether the homicide was or was not justified under the law. Self-Defense, under most statutes, has to be proven by "preponderance of the evidence" by the defense. That means they have to prove it was more likely than not that the homicide was justified as self defense.

I've had a pit in my stomach about this case for weeks. It's not like this one good verdict magically fixes our country or anything, but in its own small way at least it doesn't make things worse. The real fight begins now, though. The government will redouble their efforts to subvert the justice system to make sure that outcomes like this are impossible.
