In all technicality, the treaty does say that land is reservation land. Congress never got around to fixing it.

Back in the day, a treaty was signed to give the natives some autonomy on the area. There was no legal contingency to say that the treaty no longer applied just because the state of Ohio was established: the government has simply been ignoring them all these years, but the treaty itself remains.

Up until this point, we haven't. The U.S. basically chose to ignore the treaty for all these years, despite what it says. It can only be undone by congress.
Of course, Congress could just choose to invalidate the treaty, like they have so many times before when it came to tribal relations. I wonder what they'll do.
