Matrix is just a protocol, there are no terms of service for matrix.
matrix.org runs their own server and that does have a shitty ToS. There are lots of servers though, such as matrix.horse pony.cx, and mlp.chat

+matrix:matrix.org is just a collection of channels called matrix on the matrix.org server. The matrix protocol calls these collections a 'community', and the updated version is called a 'space' if I recall correctly. I know, it can be pretty confusing for the weak-minded.
The other thing is github. Microsoft recently purchased github. Does that mean git is shit? Well, a lot of projects moved away from the github website to something else but still use git. Weird ToS for how code is submitted is what necessitates staying with github these days. Code is too logical for it to matter much though, just means you cant say "this niggerrigged code causes crashes" when you submit a bug report. Or, you could, but the bug report might get ignored.

Having said that, tox is good too, as I recall. However it only allows text to be exchanged, nothing else.
I am very much aware of what is happening to the open source community at large. Having been keeping track of such things for a very long time, the extent that things are is at least a little surprising to me.
Matrix is still the best option anyone has for modern (very)secure communication.
